In what language should my SDS be written?

An SDS must be provided in the language of the country of destination of the substance or the mixture. For example, if you are exporting a substance to the United States and Spain, you will need to provide 2 different versions of your SDS: an English version for the USA, and a Spanish version for Spain. As the SDS is a mandatory document, it must be translated using expert professional terms in each of the languages.

The SDS is usually provided by the manufacturer, to all end users.

When is an SDS required?

A Safety Data Sheet must be prepared when the substance or mixture is considered hazardous under the CLP regulation, or if the substance is classified as PBT (Persistent, Bioaccumulative and Toxic), vPvB (very Persistent, very Bioaccumulative) or SVHC (Substance of Very High Concern) under REACH.

What are the main regulations around the world?

- GHS (Global Harmonized System): This system was created by the United Nations and provides a common basis for all countries on how chemicals should be classified and labelled. The aim of the GHS is to facilitate international trade and guarantee the safety of chemical substances by improving communication between different countries. It is now used and reinterpreted by many countries in the world.

- CLP (Classification, Labelling and Packaging): This is a European Union regulation based on the GHS. It governs everything relating to the classification, labelling and packaging of substances and mixtures considered hazardous in Europe. The main objective of the CLP Regulation is to ensure that hazard information is communicated directly to users via the label.

- HaZCoM (Hazard Communication Standard): this is an American regulation for the protection of workers. In the United States, it requires employers to disclose toxic and hazardous substances present in the workplace.

- WHMIS (Workplace Hazardous Materials Information System): This is a Canadian national workplace hazard communication standard aimed at protecting the health and safety of workers through better access to information on the hazards of substances used in the workplace. Essential elements of this regulation include hazard classification, label and SDS warnings and training programs for workers.

What are the main sections of an SDS?

Here are the priority sections of an SDS :

Section 1: Identification of the substance/mixture and of the company/undertaking
This section is used for basic information: type of product, supplier, or even country.

Section 2: Classification and labelling
This section is used to measure the potential hazard of the product being handled.

Section 3: Composition/information on ingredients
This section provides information on the content of hazardous ingredients in the product; these may influence the safety measures.

Section 8: Exposure controls/personal protection
This section provides information on the maximum authorised exposure for handling.

Sections 9, 11 and 12:
These sections present the inherent properties of the substance, the mixture or the components of the mixture.

Section 14: Transport information
This section provides information on product hazards during transport.

Who is responsible for the SDS?

The manufacturer, importer or only representative is initially in charge of the SDS. An SDS is required at all stages of the supply chain.

How do I know if my SDS is still valid (and compliant)?

There is no official validity period for the SDS. However, we consider that an SDS which is more than 3 years old is no longer up to date, as regulations are constantly evolving and are likely to affect the information relating to your substances and mixtures. Your SDS should therefore be updated regularly to avoid any non-compliance and the withdrawal of your substances or mixtures from the market.
